Germany REALLY hates BME!

Yes, it’s true… Germany has decided that BME is an abomination and, as I understand it, has made it illegal to access the site. I do not know what the penalties are, nor do I understand the specifics of the law. It MAY be legal to view BME if you are over 18. It is definitely NOT legal to make BME accessible to people under 18. I would like to ask you to continue viewing, supporting, and linking to BME as an act of civil disobedience, but that’s up to you. Below is the letter which I received, as well as the best translation I could come up with on short notice. You’d think they’d have to courtesy to send me a letter in English! If I didn’t speak enough German to sort-of understand it, I would have just tossed it…

The web site by the name of “BME: Body Modification Enzine [sic]” and the URLs of http://www.bmezine.com as well as http://bme.freeq.com is provided by the company BME / PsyberCity Inc., Toronto, Canada.
Der Inhalt des Internet-Angebot besteht aus einer Reihe von frei zugänglichen Abbildungen, unter welchen sich unter der Rubrik „BME/hard“ Darstellungen von Manipulationen der Geschlechtsorgane mittels Nadeln, Piercings o.ä. sowie von Selbstverstümmelungen, Folterszenen, homosexueller und heterosexueller Geschlechtsverkehr befinden.	The content of said internet site is a series of publically accessible pictures, among which can be found, in the category “BME/hard”, images of manipulations of sexual organs by means of needles, piercings and similar objects, as well as self-mutilations, torture scenes, homo- and heterosexual intercourse.
First of all, claiming that BME/HARD is the core of BME is offensive and ridiculous. BME/HARD is member’s only. With the exception of a very small number of sample images and the images in the menu structure, BME/HARD is members only — and this membership is only available to adults. All overtly erotic content is contained in BME/HARD. The rest of BME contains strictly cultural documentary imagery.
Das Bundesministerium für Familie, Senioren, Frauen und Jugend beantragt die Indizierung des Internet-Angebotes, da sein Inhalt jugendgefährdend im Sinne von § 1GjS sei.	The Federal Office for Family, the Elderly, Women and Youth request the ostrasizing of the aforementioned internet site since its content is endangering the youth in the sense of paragraph 1, GjS (Law for the protection of youth).
Die Verfahrensbeteiligte wurde form- und fristgerecht davon benachrichtigt, dass über den Antrag nach § 15a GjS entschieden werden soll. Sie hat sich nicht geäußert.	The owner of said internet offer was previously informed in good time of the instigation of these proceedings under article 15a GJS, however has not commented (on the rightfulness of these proceedings).

The web site by the name of “BME: Body Modification Enzine [sic, again]” and the URLs of http://www.bmezine.com and http://bme.freeq.com was to be added to the index according to the proposition.
Ihr Inhalt ist offenbar geeignet (§ 15a Abs. 1 GjS), Kinder und Jugendliche sozialethisch zu desorientieren, wie das Tatbestandsmerkmal „sittlich zu gefährden“ in § 1 Abs. 1 Satz 1 GjS nach ständiger Spruchpraxis der Bundesprüfstelle sowie höchstrichterlicher Rechtsprechung auszulegen ist.	Its content is obviously capable (§ 15a par. 1 GjS) of socially and ethically disorienting children and youths, as the criterion “morally endangering” in § 1 par. 1 sentence 1 GjS is to be interpreted according to common usage as well as according to the jurisdiction of the high court.

Eine Darstellung ist pornographisch im Sinne von § 6 Nr. 2 GjS, § 184 Abs. 1 StGB, wenn sie unter Ausklammerung aller sonstigen menschlichen Bezüge sexuele Vorgänge in grob aufdringlicher Weise in den Vordergrund rückt und ihre objektive Gesamttendenz ausschließlich oder überwiegend nur auf das lüsterne Interesse des Betrachters an sexuellen Dingen abzielt (vgl. BGHSt 23, 44; Lenchner in: Schönke/Schröder, Kommentar zum Strafgesetzbuch, 21. Aufl., Rdnr. 4 zu § 184 StGB). A rendering is pornographic in the sense of § 6 no. 2 GjS (§ 184 par. 1 StGB) if it pushes sexual practices into attention excluding all other human relations and contexts in a blunt, obtrusive way, and if its objective total tendency aims exclusively, or mostly, at visitors’ lusty interest in sexual issues (reference to BGHSt 23, 44; Lenchner in: Schönke/Schröder, commentary to penal code, 21. ed., marginal no. 4 to § 184 StGB [penal code]).
Das verfahrensgegenständliche Angebot stellt sexuelle Aktivitäten detaildrastisch dar und bevorzugt die Hervorkehrung genitaler Einzelheiten. Ein relativer Kontext – etwa ein Bezug zu außersexueller Thematik – ist nicht erkennbar.	The indicated content renders sexual activities drastically and in detail and prefers focusing on genital details. A relative context — such as a connection to non-sexual topics — is not detectable.
Deciding that BME/HARD is pornographic is one thing. It has a clearly sexual nature. However, condemning the rest of BME because of this shows a real lack of understanding of the community that thrives around BME. Admittedly people may enjoy BME on a sexual level, but that is secondary to the culture that has embraced it.
Im Rahmen der auch in disem Einzelfall gebotenen Abwägung zwischen Kunstfreiheit und Jugendgefährdung bzw. Sozialschädlichkeit erwiesen sich Strukturmerkmale, wie sie in Rechtsprechung und rechtwissenschaftlicher Literatur zur Ermittlung der Werkhöhe entwickelt wurden, als sehr eingeschränkt tauglich. Die Frage etwa, nach dem Ansehen bei Publikum, Kritik und Wissenschaft, erscheint angesichts der Struktur des Angebotes (das sich bei näherer Betrachtung in einer Zusammenstellung pornographischer Materialien billiger Machart erschöpft) nachgerade absurd. Da die Web-Site den Gattungsanforderungen eines anerkannten Werktyps nicht entspricht, sich ferner die Aussage- und Interpretationsfähigkeit weitgehend unkommentierter pornographischer Darstellung in sehr eng bemessenen Grenzen hält, hat das Gremium die Werkhöhe im Ergebnis als zu vernachlässigende Größe eingestuft und dem Jugendschutz den Vorrang eingeräumt. Ein Fall von geringer Bedeutung gemäß § 2 GjS liegt nicht vor. Die Richtung der Entscheidung nach § 2 GjS ist stets in der Weise vorgezeichnet, dass die Listenaufnahme einer jugendgefährdenden Schrift dem Gesetz näher steht als das Absehen von der Aufnahme: Der Sinn der Ermessensermächtigung des § GjS besteht darin, der Bundesprüfstelle zu ermöglichen, von einer nach der grundsätzlichen Zielsetzung des Gesetzes an sich gebotenen Listenaufnahme abzusehen, wenn ihr dies aufgrund besonderer Umstände im Einzelfall – ausnahmsweise – angemessen erscheint (OVerwG NRW, Urteil vom 23.05.1996, 20 A 298/94). Hinweise auf derartige Umstände lagen dem Gremium nicht vor. Darüber hinausgehend ist zu erwarten, dass ein großes und der Altersstruktur nach disperses Publikum das Angebot wahrnehmen wird, zumal der Hostmaster keinerlei technische Vorkehrungen dahingehend getroffen hat, den Zugang zu den inkriminierten Angebotsseiten auf ein erwachsenes Publikum zu beschränken.	This is not a case of low importance according to § 2 GjS. The overall direction of the judgment is predetermined in such a way that the addition of a document potentially endangering the youth is closer to the law than the omission of said addition. The federal examination office can exceptionally omit the addition of a document to the index for certain reasons, even if said addition would generally be recommended. Such special reasons were not evident to the office in charge. Moreover, it is to be expected that a large public unrestricted to certain age groups will make use of said documents, since the hostmaster has not taken any technical precautions toward limiting the incriminated pages to an adult public.
Rechtsbehelfsbelehrung	Information as to judicial possibilities
Gegen die Entscheidung kann innerhalb eines Monats ab Zustellung schriftlich oder zu Protokoll der Geschäftsstelle beim Verwaltungsgericht Köln, Apellhofplatz 1, 50667 Köln, Anfechtungsklage erhoben werden. Die vorherige Einlegung eines Widerspruchs eintfällt. Die Klage hat keine aufschiebende Wirkung. Sie ist gegen die Bundesrepublik Deutschland, vertreten durch die Bundesprüfstelle zu richten (§§ 20 GjS, 42 VwGO). Außerdem kann innerhalb eines Monats ab Zustellung bei der Bundesprüfstelle Antrag auf Entscheidung durch das 12er-Gremium gestellt werden (§ 15a Abs. 4 GjS).	Charge of contestation [Anfechtungsklage] can be undertaken against this decision within a month from delivery at the Administrative Court of Cologne [Verwaltungsgericht Köln, Apellhofplatz 1, D-50667 Köln], in writing or for the protocol of the [Geschäftsstelle beim Verwaltungsgericht Köln]. The previous handing in of opposition is obsolete. Charges do not cause adjournment. They are to be directed at the Federal Republic of Germany represented by the federal examination office [Bundesprüfstelle] (§§ 20 GjS, 42 VwGO). Apart from this, the request for judgment by the jury of twelve can be filed within a month from delivery at the federal examination office (§ 15a par. 4 GjS).
Obviously I can not fairly be expected to offer up a legal defense in Germany. I have neither the resources or the finances to do so. So I can only hope that Germany comes to its senses; if not, Germany will be alienating many of its citizens whose lives are improved by the presence of sites like BME.

I think that the BJPS has overlooked a few very important facts in its condemnation of BME. First of all, 99% of the publicly accessible sections of BME have no erotic content whatsovever. Secondly, the parts that do are not just pornography like so many sites on the internet — including many produced in Germany. BME is in many areas the sole public outlet for this subculture — that includes BME (mainstream/public), BME/extreme, and even BME/HARD.
